Any agreement is worthless unless you have the wherewithal to enforce it. That's why China gets away with Murder, because there side will not back our side in any litigation, especially with something as small as the speaker cabinet industry.

There is also the issue that this site is called, "free" speaker plans.
Unless there is a warning somewhere on the site about commercial use??

Hi Nicky Its people like these who spoil it for the rest of the fair minded community I know Mr Cubo states "Build as many as you like Contact me for a licensing agreement if you want to build on a commercial basis ,, Rog Mogale often states on his cab designs Build four and contact me for an agreement for commercial builds which to me is fair enough I am now running 4 x Cubo15 and I love them !! a friend who is seriously impressed has asked me to build him a pair but this is no way a commercial build its more like I Want hahaha and is a case of you get the wood and the drivers, I will throw them together and you can finish the things yourself lol I can understand why some designers and there is one on here who has said "Thats why I don't give freee plans any more !!!!If I do get enquireies I will be talking to Mr Cubo !!!! In this country they will rip any thing off if the crazy foreigners are daft enough to giv it away ,, Sorry Rant Over !!!

Take Care ,, Dave/Luz !!!

Licensing agreements will always be a very grey area, mainly because people don't understand what can be protected and how. Most speaker designs wouldn't get copyright because they are just using proven methods. Another important issue is that unless there is an appropriate witnessed document that proves that a drawing existed before the product, no one can claim copyright. If you are not protected, then it's pointless people thinking they can license their modified cabs. This has nothing to do with Patents, which is a different issue. Even if a product is protected in the UK, it will only hold up if the law of the land in another Country supports you.
Hence, the China situation.

Tony,,
Thank you for your input and explanation, I understand what you term the "China Situation). as a relative newcomer to both to the forum and tto the art of building my own speakers. I persued the sllf build option to get away from the poor quality of hte speaker systems generally available here in the Philippines that originate a couple of hours across the water ! I may not be the world best DJ/KJ but I do actually care about the sound that I put out. unlike many here who prefer half a dozen pieces of chipboad with a hole in it to mount the speaker !! sourcing name / Quality gear can at times be frustrating. for example getting T-S parameters is a bit of a no no, dealers will tell you "IT IS 18 INCHES SIR" trying to explain that some of the cabs are driver specific draws a blank look and "Yes it is 18 Inch It will work" your going to have to call me old fashioned I just find it out of order that these companies can use the plans from here and other sites including the designer / Builders build pic's passing thel off as their own without acknowledgement to the designer or the source material. Personally I don't have the inclanation to set up a cottage industry knocking out a quality product which if i understand your replies correctly I wouold be at liberty to do qnd it would be to my honesty or sense of "Fair Play" to pass a royalty to the designer !!

Once again thanks for taking time to respond , it is appreciated
Cheers Dave an Luz. (Just call me Old Fashioned)!!!

@ Dave, I agree, was just pointing out the word, "free" would certainly not help in court etc.

I must be getting old Nicky !!!

I know I am a relative newby here but I just find it a bit off !! I have not encountered many here but those I have are helpfull and supportive in the spirit of the forum ,, the guys who have posted plans have obviously put a great deal of time and effort into the project and continue to do so in the way of providing support example moddelling fifferent drivers for builders I just dont like to see these guys taken advantage of by those after a quick buck I could quite eassily do the same here I have the room but not the inclination ,, I could not do it and not do it properly !!

about your latest post its about the same legal leval as the use of the term "Reasonable" another grey area !!

Cheers Dave and Luz
(Dave is now officially getting old and definatly old fashioned) smiley1
